Backyard Enjoyment

 

"So I was in my fenced backyard enjoying myself when someone said "excuse me sir but you cant do that out here." The cop said he yelled but let himself into my yard when I didn't answer. He said the neighbors had called to report me. He didn't give me a ticket for "lewd public act" as he put it thank god. Is it illegal?"

I assume by "enjoying yourself" you mean masturbating. Laws vary by jurisdiction, but in most places everyone is entitled to a "reasonable expectation of privacy." That means what you do in the privacy of your home or fenced-in yard --- provided sightlines are blocked from easy view --- is your business.

You can wander around naked and jacking off inside your house. But if you do it in a window where the public can see in, well, that could be considered a "public act."

Do your neighbors have a two-story home? Do windows on the upper floor face your property? If so, then easy view is a given. But still.... They could've simply closed the drapes or blinds instead of calling the police.



If the police indicated which neighbor called to report you, you may want to go ask why. Perhaps they have small children occupying the room facing your yard. In which case, I'd suggest you move your "enjoyment" out of their sightlines. They don't have to worry about seeing it. You get to have your fun.

Laws vary depending on the state you're in, but there's near-unanimity that your reader should make sure his neighbors can't see him jerking off or even only nude. He has a fenced yard, that's fine, but the fence needs to be high enough that his neighbors can't see him unless they climb a ladder or other means of raising themselves.

Yes, 'expectation of privacy' is kind of a slippery slope. If there's houses around that are more two stories, jerking off in the backyard can be a problem. He's going to do some landscaping in that backyard and plant some tall trees.

I think as long as we're in our own house or backyard, we have to use common sense. I know I've sat out back and jacked off many a night, me and the lad even had sex in the backyard. Of course this was in the cover of Darkness. In the daylight even though we have a lot of gardening,trees and plants it could still easily be seen. So I think Common Sense has to be used where and what time we're going to be doing it

Depending on how difficult or easy it was for the complaining person to see into the guy’s yard to see what he was doing, the complainer may violate a voyeurism statute.

Everybody in the US has the right to a reasonable degree of privacy. This was read in your Constitution by SC Justice Louis Brandeis over a century ago. However there are always exceptions. Was the neighbor looking out of a 2nd floor window, for example? At the same time the police also have discretion on how to proceed. Had he ticketed me I would have fought it in court. I can't see how it could be considered a 'lewd public act' when it occurred in the privacy of your own backyard. Mind you your country has gotten so puritanical these days about anything that is even remotely sexual as the extreme alt right is waging a war on identity.

We planted a tree several years ago that blocks the one second story window which looks out over our backyard. Made sure it covered the sight line. Last year it covered the view for the first time. Am enjoying the added privacy.

Last year my neighbor extended their house with all the necessary permits. Felt I could not object (sorry but I masturbate in my fenced garden and there are no trees on the boundary!!) Unfortunately, their new children's room overlooks my garden, so am now waiting for the trees I planted to grow & until then there are less points in the garden to enjoy!!!

@ Jean - I agree. We have a pretty good relationship with our neighbors that we can call (or text) if something is awry and we don't need to mince words for fear of offending. Hugs and bisous.

Seen this a few times over the years. Friends, family and other people we know have all had some form of this happen to them. The shitty neighbor stories. We all have them. My partners parents had one set of neighbor's complain about his dads frequent nudity. His dad is a nudist at the home but a few times he would collect the bins nude that are out front very early in the morning (usually just before sunrise). Neighbor didnt like it, complained and for the following week his dad would go out in a robe to get the bins, turn and face the complaining neighbors house and flash them.

One thing we found from all of it was if the neighbors house has cameras, none are to be positioned so they see into their neighbors yards otherwise its invasion of privacy and filming without consent.

It will get worse when the neighbor sues you for injuries sustained from falling off the ladder that was needed to see over your fence.
