Some areas have laws regarding consent, especially when it comes to where you would have a reasonable expectation of privacy, like a bathroom or bedroom - regardless if it's a spouse.

Seems a little odd to me. Hopefully she's not going to attack him or something in his vulnerable state of sleep. Being secretly recorded or photographed seems like the bigger privacy issue here. Yes you are husband and wife, but it seems there should be some personal boundaries and respect. Your bodies are between the two of you, not leaked somewhere accidentally on a phone.
